1: By placing an order with Micrositez® you confirm that you are in agreement with and are bound by the terms and conditions below. These terms are effectual from the point that payment is received from a client whether in full or in part and are governed under Scottish law.
2: You expressly agree that use of the Micrositez® services provided hereunder is at your sole risk. These Services are provided on an "as is" and "as available" basis. Micrositez® expressly disclaim all warranties of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose or non-infringement.
3: The customer agrees that they have not created and must not create any duplicate sites on similar or mirror type domains (including additional domains on framed redirects aka non-seo friendly redirects) – additional domains pointing to the clients site are only considered SEO friendly if they are on a correctly formatted 301 redirect. The customer further agrees that they have not created duplicate content/pages on their existing site, used deceptive redirects or doorway pages, used cloaking methods or have attempted to fool the search engines by showing content to the search engine spiders which cannot be seen in the browser naturally (by the end user).
4: The customer agrees that they have not requested and must not exchange links with any bad neighbourhoods or undertaken any link spamming techniques which may harm the website's search engine ranking with Google this includes linking out to bad neighbourhoods whether knowingly or unknowingly.
5: The customer agrees that they have not and must not use any on-page black hat techniques, for example the customer must NOT have used and must not use hidden text anywhere on their site or use keyword spamming on pages or in the HTML code, such as, keyword tags or comment tags etc...
6: If hidden text, spamming links or any of the above black hat methods are found to have been employed by any client before during or after Micrositez® have started their SEO campaign, Micrositez® reserves the right not to uphold any ranking assurances (if given) and to cancel further work to the particular SEO campaign if necessary
7: Micrositez® cannot and DO NOT guarantee rankings for any website on any search engine at any time. Where a ‘Top 10 assurance’ has been given; Micrositez® consider a top 10 result secured when the client’s website remains in the Top 10 of Google UK for a period of 4 consecutive weeks (minimum) or more. Once a Top 10 result has been seen to have been secured it is the client’s responsibility to maintain the result by arranging additional seo in an ongoing fashion or in the form of a maintenance package from Micrositez®. In the unlikely event that a ‘Top 10 assurance’ (where given) is not achieved within the agreed timeframe Micrositez® will continue to work free of charge to secure the Top 10 result for (up to a maximum of) a further 6 months. Micrositez® cannot be held liable or be held responsible for negative fluctuations in any clients search engine positions or if a client’s site is excluded at any time from any search engine index.
8: Micrositez® is not responsible for any adverse affects on search engine ranking or for additional costs incurred if the client has engaged in overwriting On-Page SEO work already carried out on the site by Micrositez® (whether intentionally or accidentally). For example when the client or the client's webmaster has made changes and uploaded or overwritten on-page seo work that has already been provided by Micrositez®. Neither can Micrositez® be held responsible when on-page seo work has been overwritten by other parties which may have adversely affected the search engine rankings of the client’s website. Any remedial work required to correct overwritten or adversely affected on-page SEO will be charged to and will be payable by the client.
8b: Where On-page SEO has been carried out by Micrositez®, the customer agrees to allow Micrositez® to place a discreet text link in the footer of their website with the anchor text ‘SEO’.
9: Micrositez® will carry out work only where an agreement is provided either by mail, email or telephone and after payment has been made. Micrositez® will carry out work only for clients who are 18 years of age or above.
10: Micrositez® is not affiliated with any search engine network or directory - ALL third party logos or images used on this site remain copyright of their respective companies.
10a: Micrositez® reserves the right to substitute any particular aspect of our link building packages for another aspect, for example we may at our discretion substitute profile links for social bookmarks or give extra directory submissions in place of less forum posts etc. This may be done where certain link inventory is not available or where a discretionary change is considered by Micrositez® to be of more benefit to the client over the original package.
11: Micrositez® cannot be held responsible for delays or failure of performance resulting from Internet Service Provider delivery problems or failure, including hosting issues where your site is unavailable at any time or any communication or delivery problems associated with Client's receipt of the Account Service data. Micrositez® shall not be responsible for acts or causes beyond their control, including but not limited to: acts of God, strikes, lockouts, communications line or equipment failures, power failures, earthquakes, or other disasters.
12: Micrositez® do not warrant or represent that the use or the results of the use of the materials available through Micrositez® services or from third parties will be correct, accurate, timely, reliable or otherwise.
13: Notwithstanding the security precautions taken against disclosure of information, there are certain conditions that exist on the Internet generally which are outside Micrositez® control and could result in a breach of security. Accordingly, Micrositez® cannot guarantee that Your Account Service data information will be free from corruption or piracy. You hereby expressly waive any claim against Micrositez® arising out of the loss of data through corruption, piracy or breach of security.
14: To the maximum extent allowed by law, Micrositez® and any of their parents, members, subsidiaries, affiliates, partners, service providers, licensors, officers, directors or employees shall not be liable for any direct, indirect, special, incidental or consequential damages (no matter how they arose, including negligence), or for interrupted communications, lost data or lost profits, arising out of or in connection with the services provided hereunder. Further, Micrositez® will not have any liability for any losses arising because the Micrositez® services are not operational or accessible. This section does not limit liability for bodily injury of a person.
15: As a Christian owned business Micrositez® do not promote sites whose content is deemed unsuitable. Examples of unsuitable content may include (but are not limited to) illegal, adult or offensive content, new age, occult, hate sites, pornography (of any type), spiritualism, mediumship or content where extreme political or propagandist views are expressed... neither do we provide seo for gambling sites, pharmacy sites or 'Made for Adsense' or similar sites. All content is deemed suitable for seo promotion at the sole discretion of Micrositez® management.
16: To process any order we require initial payment for your service by cheque, credit/debit card payment or by bank transfer (BACS/CHAPS). Subsequent monthly payments may be made available through our easy payment scheme in monthly instalments. Please note: If easy payments are not met in a timely fashion the easy payment option may be withdrawn at which time the full amount of the account balance will become payable. Micrositez® regrets that once any payment has been received NO REFUNDS CAN BE GIVEN.
Anyone who experiences a problem with the service provided by Micrositez® should raise the matter with us directly by e-mail giving sufficient information and clearly outlining the grounds for complaint.
